The Department of Telecommunications (DoT) recently published a checklist of documents for Internet Service Providers (ISPs) interested in surrendering their ISP license. The Telecom Department published three separate checklists for ISP license surrender before the start of service, ISP license surrender after the start of service, and surrender of ISP license authorization under Unified License.
ISPs looking to surrender their authorization under Unified License need to draft an application on company letterhead under the signature of the authorized signatory as per DoT format along with board resolution regarding the decision of the company to surrender the Unified License and ISP authorization under relevant clauses of Unified License and detail of authorised signatory including name and designation along with the specimen signature and an undertaking regarding advance notice of 30 days to the customers if the service is in operation.
ISPs looking to surrender ISP license after the start of service need to apply for surrender of ISP license after the start of service on company letterhead under the signature of the authorized signatory as per DoT format along with board resolution for surrendering ISP license after the start of service under the relevant clause of ISP license with detailed information of authorised signatory. The ISP licensee also requires to submit 30 days advance notice to DoT for the surrender of license, undertaking regarding advance notice of 30 days to the customers if the service is in operation, proof of surrendering the resources, and proof regarding the start of service.
ISPs looking to surrender their license before the start of service need to submit an application for surrender of their ISP license company letterhead under the signature of authorized signatory along with board resolution for surrendering of the ISP license before the start of service under the relevant clause of ISP license and detailed authorized signatory information. The ISP licensee also needs to give 30 days advance notice to DoT for the surrender of license and pay surrender charges equivalent to 2.5% or 5% of PBG in the form of Demand Draft.
