A five-judge Constitution bench headed by Chief Justice Dipak Misra, which is hearing a clutch of pleas challenging the constitutional validity of Aadhaar and its enabling Act, was told that a boy was denied admission in school after his father denied giving biometric details for Aadhaar on the ground that their religion does not permit it.

"In secular matters, can you say that I will not opt for it. For example, can a person refuse to opt for the Income Tax saying that his conscience does not allow it," the bench, also comprising justices A K Sikri, A M Khanwilkar, D Y Chandrachud and Ashok Bhushan, said.

The Supreme Court today refused to pass an interim order extending the deadline of March 31 for linking of Aadhaar with the welfare schemes where benefits are transferred to citizens from the Consolidated Fund of India.

The top court had on March 13 extended indefinitely the March 31 deadline for linking bank accounts and mobile phone numbers with Aadhaar.

However, it had allowed the government and its agencies to link the 12-digit national biometric identifier number of the beneficiaries for transfer of benefits of schemes funded from this fund.

The Unique Identification Authority of India (UIDAI) that is operating the Aadhaar numbering scheme for residents, is unable to make any assertion about the uniqueness of its database, reveals information received under Right to Information (RTI) Act.
Dr Anupam Saraph has filed the RTI seeking information on unique names, addresses, mobile numbers, email IDs, biometrics and documents in the UIDAI's Central ID Repository (CIDR) database. Replying to the RTI, UIDAI said, "No such information is available or maintained by UIDAI, RO, Mumbai."

If not Aadhaar, a consent form will get parents ration for their children

A 'consent form' will now allow parents who have not yet got their Aadhaar cards made to take ration for their children under Poshan Abhiyaan. The government has stressed on making Aadhaar mandatory for people to avail ration from Anganwadis, despite constitutional validity of Aadhaar being currently discussed in the Supreme Court.

However, the women and child development ministry officials have figured out a middle path. According to the new measures, now parents and children who will get their Aadhaar cards made will have to sign a consent form allowing the Anganwadis and the district collector to use their information.

After the ruling by SC, an undertaking will be signed by parents wanting to avail ration - by agreeing that their information on other identity proofs will be used and shared by the government.
 
Biometric failure is not related to age, says UIDAI

The Unique Identification Authority of India (UIDAI) claimed there is no “conclusive evidence” to say that biometric authentication success is dependent upon age. “Slightly higher authentication failure rates have been observed only for fingerprints for senior citizens above the age of 70,” UIDAI CEO Ajay Bhushan Pandey said in a written reply in the Supreme Court on Tuesday to a questionnaire from the petitioners challenging the Aadhaar scheme.

Mr. Pandey said several alternatives to biometric authentication are available. Besides, an Aadhaar holder could always update his biometrics.

The UIDAI on 3 April published a list of Frequently Asked Questions in national dailies, in an effort to address concerns with Aadhaar. The issue that arises with some of the statements made in these FAQs are not so much that they are incorrect, but that they present an extremely narrow perspective of Aadhaar, and only portray Aadhaar as it is intended to be on paper, as opposed to the actual situation.
