Delhi High Court in its decision says 3G roaming between Airtel, Vodafone and idea cellular is valid. This is a major relief to telecom giants like Airtel, Idea Cellular and Vodafone India, Delhi High Court on Thursday dismissed the plea of the DOT (Department of Telecom) in the 3G intra roaming case.
The delhi high court upheld that telecom tribunal (TDSAT) has jurisdiction over the matter and if DoT is unhappy with the trubinal’s final order, then they are free to move to Supreme Court.
DoT said TDSAT has nothing to do in this 3G roaming jurisdiction and licence terms and conditions entered among the operators and the DoT.
Now Airtel, Vodafone, and idea cellular are free to offer 3G services in any circle with 3G roaming agreement otherwise if TDSAT cancel these roaming.
Earlier DOT said that 3G roaming between Airtel, Vodafone and idea cellular is illegal and they have to stop services but these operators challenged this decision in TDSAT. Now Aircel and Tata Docomo may also start their 3G roaming services until final verdict delivered by TDSAT or Supreme court.
