In less than a week, Bharti Airtel finds itself in a legal tangle yet again and this time it is for some irregularities with their Do Not Disturb (DND) service, which has been brought to the notice of the Madras High Court. According to reports, Advocate K Ramakrishna Reddy had to take the matter to the Madras High Court when he realized that the popular national mobile service provider had been pushing promotional calls and messages to the cell phones of several lakh customers. Advocate Reddy, in addition to this also sought for an interim direction to Airtel to get the DND service activated on his cell phone, immediately. Reportedly, following his appeal in the Madras High Court, Justice S Rajeswaran ordered Bharti Airtel to activate the DND service on Advocate Reddy's cell phone and his add-on connection, with immediate effect, thereby ensuring that all promotional calls and messages coming to his cell phone would be duly blocked on the activation of the DND service.
The Madras High Court further issued notices to both Bharti Airtel, and the Telecom Regulatory Authority of India (TRAI). In his complaint to the Madras High Court, Advocate Reddy alleged that he approached the Madras HC after a string of failed attempts to get an answer from the company. According to the report, Reddy had sent "over a score of SMS" to Bharti Airtel, neither of which garnered any response. He then sent two registered letters to the company, on March 4 and May 6, respectively, last year. Reportedly, Airtel issued a reply to Reddy's second letter, wherein he was asked to make a note of the SMS details, like the phone numbers, contact numbers, gist of the message and the time the SMS was received. He listed down all the details, asked for by the company in a tabular form. Reddy, further alleged that between June 8, 2011 and June 30, 2011 he had received about 55 SMS/calls, thereby cementing his claims that Airtel hadn't activated the DND block on his number.
The report further adds that a miffed Reddy demanded a total sum of Rs. 5,20,000 as consequential damages, coupled with an interest of 24 per cent per annum and an additional Rs.45,000 per month from March, this year, till the date when the DND facility was activated on this cell phone. In his petition to the Madras High Court, Advocate Reddy, reportedly also sought for TRAI intervention to "take appropriate action againt Bharti Cellular for "violating" the regulations governing the DND facility."
DND, or the Do Not Disturb facility has been one of the telecom sector's path breaking facilities introduced to the subscribers, only recently. This facility benefitted those who were most miffed with the endless stream of promotional calls and SMSes that they were receiving, each day. The government went ahead to limiting the maximum number of SMSes that one could send in a single day to 200, in a further attempt to put an end to these unwanted calls and SMSes. Users also have the option of putting their number in the DND registry, following a simple process, to ensure that their number is not flooded with such calls and SMSes.
