The Lok Sabha today strengthen the existing Anti Hijacking Law, by passing the Anti-Hijacking Bill 2014, which provides death penalty for the hijackers even if ground handling staff and airport personnel are killed during such acts.

The earlier law gave provisions to hijackers and they could only be tried for death penalty only in the event of death of the hostages. The Anti-Hijacking Act of 1982, was last amended in 1994 and has been today repealed and replaced with a new one. The amendments in the Anti-Hijacking Bill, 2014 were cleared by the Cabinet in July 2015.

The Indian authorities and lawmakers felt for amendment after the hijacking of Indian Airlines Flight IC-814 in December, 1999, it was felt that the hijackers must be awarded with death penalty in such acts. The 9/11 incident that took place in United States in 2001, where aircrafts were used as weapons, also pushed the need to further amend the existing Anti Hijacking Act.

The new act provides capital punishment for hijackers for killing hostages or security personnel or any airline and airport staff. The new act can also award life imprisonment with confiscation of movable and immovable property of the accused.

The Bill was introduced in Rajya Sabha in December 2014 and was referred to the Parliamentary Standing Committee on Transport, Tourism and Culture. Almost three months later the committee, suggested various changes including making hoax calls a punishable offence and providing appropriate compensation for victims of hijacking. The panel also recommended the government to define the terms ‘hostage’ and ‘security personnel’.

The amendments in the Anti-Hijacking Bill, 2014 were earlier cleared by the Cabinet and in July 2015. The bill was passed by Rajya Sabha last week and was today passed by Lok Sabha, news agency ANI reported.
